Settlement of bad debts

Conditions of and procedure for debt settlement and measures applied to an insolvent borrower

What reasons to contact the Bank?

  • Being unemployed (redundancy, resignation)
  • Reduction/delay of salary, leave without pay;
  • Maternity or parental leave;
  • Temporary disability of the borrower due to illness;
  • Left without a breadwinner (death of close relatives, divorce, etc.);
  • Other circumstances, including force majeure/emergency.

What are the ways of debt settlement?

The terms and procedure for debt settlement are stipulated by Article 36 of the Law of the Republic of Kazakhstan “On Banks and Banking Activities in the Republic of Kazakhstan”.

How to apply?

  1. Apply to amend the terms and conditions of the bank loan agreement at the bank outlet, to the e-mail Info@halykbank.kz, via the bank's Internet resource;
  2. Provide supporting documents, indicating a decrease in income and inability to pay the debt, according to Annex No.1;
  3. Within 15 (fifteen) calendar days from the date of receipt of the application, the Bank shall provide a response on:
  • consent to the proposed amendments to the terms and conditions of the bank loan agreement;
  • its proposals on amendments to the terms and conditions of the bank loan agreement;
  • refusal to amend the terms and conditions of the bank loan agreement specifying the reasoned justification of the reasons for such refusal.

Measures taken by the bank in case of the borrower's non-compliance:

  1. Foreclose indisputably on the money, including by filing a payment request, available on the borrower's bank accounts in accordance with the requirements of the legislation of the Republic of Kazakhstan;
  2. File a lawsuit in court to recover the amount of debt under the bank loan agreement, as well as to foreclose on the pledged property in an extrajudicial procedure (except for cases stipulated by the legislative act of the Republic of Kazakhstan on mortgage of real estate) or in court;
  3. Transfer the debt to a collection agency for pre-trial collection and settlement;
  4. Assign the right (claim) under the bank loan agreement in compliance with the requirements established in Articles 36 and 36-1 of the Law of the Republic of Kazakhstan “On Banks and Banking Activities in the Republic of Kazakhstan”.
